Approaching the new policy of investment immigration

 

On July 20, 2022, New Zealand Economic and Regional Development Minister Stuart Nash and the new Immigration Minister Michael Wood jointly announced the new New Zealand investment immigration policy: Active Investor Plus Visa.

On August 9, 2022, at the invitation of NZTE (Newland Trade & Enterprise), Newland Capital Management Limited participated in the Active Investor Plus Information Evening (“Active Investor Plus Information Evening”) jointly organized by NZTE and INZ (Immigration New Zealand) “New Investment Immigration Policy Explanation Session)

 

 

Part 1

The Policy Objectives of the Investment Immigration

 

NO.1  

Encourage more active investment in early-stage and growth-oriented sectors of the economy to support increased productivity and competitiveness.

 

NO.2  

Attract international investment into the economy to support our business growth and create quality, well-paying jobs in New Zealand.

 

NO.3  

Target skilled and experienced international investors, become active participants in the New Zealand investment system and provide New Zealand companies with improved global knowledge, networks and market skills.

 

Part 2

NO.1 

Replace the current first-class (Investment Plus) and second-class investment (Investment) immigrants with “Active Investor Plus”.

 

NO.2 

The actual investment amount shall not be less than NZD 5 million, and the weighted investment amount shall be no less than NZD 15 million.

 

NO.3  

Establish an NZTE promotion mechanism to encourage risky direct investment through a “weighting system” (Weighting system) bonus points.

 

NO.4

The investment period is three years, which can be extended until closer to the end of the fourth year. You must live in New Zealand for 117 days in four years.

 

NO.5

The main applicant needs to pass IELTS (IELTS: International English Language Testing System) or equivalent measurement standard to reach at least level 5. There may be circumstances in which the language requirement can be waived, such as studying in an English-speaking country.

 

NO.6

The old investment immigration policy will be terminated on July 27, 2022 (applications submitted under the old immigration policy will still be implemented under the old policy), and the new investment immigration policy will be implemented on September 19, 2022.

 

Part 3

Weighting system

 

 

NO.1  

Direct investment (3x weighted) in private business is subject to Immigration New Zealand’s “acceptable investment” criteria.

 

Invest in a New Zealand private incorporated company that:

Have previously or will receive funding from an eligible fund (approved under the private equity fund eligibility criteria), or

be listed on the NZTE live trading platform; or

 NZTE is promoting the investment, or NZTE has identified as acceptable direct investment.

NZTE’s Draft Standard:

· New Zealand  legal entities (including Māori entities) with a New Zealand Business Number (NZBN)

· Comply with NZTE’s risk management procedures;

· The capital must be used to support areas of business growth identified by NZTE, or to create/save jobs (which will be of economic or other benefit to New Zealand); and

· Entities are already trading/operating;

·  NZTE will apply to add a criterion for venture capital, where direct investment is in pure greenfield or start-ups, or involves significant real estate assets.

 

NO.2  

Private equity industry funds (2 times weighted) Subject to Immigration New Zealand instructions and ‘acceptable’ list criteria.

Any private equity fund registered in New Zealand that meets the following conditions 

·  Be on the fund’s whitelist*; or

· Funds identified as “acceptable”.

*  The whitelist may initially include any funds receiving investment from the NZGCP, NZ Super Fund, ACC and potentially other government funds. Please note that non-government backed funds will have a procedure to meet the required evaluation criteria.

 

The main points of the draft high-level standards for funds are:

  • Invest in New Zealand entities that clearly contribute to the government’s economic strategy (by being a high growth potential company or contributing to positive social and economic impact)
  • Appropriate checks have been conducted to ensure that the operation is legal; andInvestments do not damage New Zealand’s reputation as a responsible member of the international community.

 

NO.3
